Over the past 23 years, France has: (i) always refused to acknowledge its role in the Genocide; (ii) attempted to transfer responsibility for the Genocide onto others; and\/or (iii) failed fully to investigate, prosecute or bring to justice suspected g\u00e9nocidaires living in France. Most recently, France has failed to respond to requests for mutual legal assistance by the Government of Rwanda in respect of ongoing investigations against suspected g\u00e9nocidaires living in France and has failed to declassify all relevant documentation related to the Genocide. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"2\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Each of the shortcomings set out above constitutes a breach of France\u2019s international human rights obligations. They are serious and significant and have taken place throughout France\u2019s last UPR cycle (2013 \u2013 2017). <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"2\" type=\"I\">\n<li>\n<h2 class=\"western\"><a name=\"_Toc483172430\"><\/a><a name=\"_Toc486242071\"><\/a> <span style=\"font-family: Calibri Light,serif;\"><b>FRENCH FAILINGS IN RESPECT OF THE GENOCIDE <\/b><\/span><\/h2>\n<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>\n<p align=\"justify\"><a name=\"_Hlk485111997\"><\/a> <span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Throughout the last UPR cycle, France failed to act in accordance with its international human rights obligations in respect of the Genocide and has failed to adhere to fundamental principles of truth, justice and accountability.<a class=\"sdendnoteanc\" href=\"#sdendnote2sym\" name=\"sdendnote2anc\"><sup>ii<\/sup><\/a> France has also failed to act in accordance with the recommendation made by Armenia and accepted by our country in the second cycle of the UPR to \u201c<\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>continue its efforts to contribute on the prevention of crimes against humanity, particularly genocide, and to the fight against negationism of past historical facts<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">\u201d.<a class=\"sdendnoteanc\" href=\"#sdendnote3sym\" name=\"sdendnote3anc\"><sup>iii<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"4\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We draw each of these failings to the Human Rights Council\u2019s (\u2018HRC\u2019) attention. We set out our recommendations in respect of each of the below failures in section III. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc486242072\"><\/a><span style=\"font-family: Calibri Light,serif;\">The Non-Acknowledgement of the Role of France in the Genocide<\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"5\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Allegations as to French complicity in the Genocide are well documented.<a class=\"sdendnoteanc\" href=\"#sdendnote4sym\" name=\"sdendnote4anc\"><sup>iv<\/sup><\/a> Between 6\u00a0April and July 1994, over a million Rwandans, the majority Tutsis, were massacred at the hands of Hutu extremists. While the international community stood by and allowed the Genocide to continue for over 100 days, French officials \u2013 and hence the French State \u2013 were complicit in the Genocide.<a class=\"sdendnoteanc\" href=\"#sdendnote5sym\" name=\"sdendnote5anc\"><sup>v<\/sup><\/a> Allegations as to France\u2019s role in the Genocide are extensive, well-documented and comprise:<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol>\n<ol type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">training and arming of those who became g\u00e9nocidaires;<a class=\"sdendnoteanc\" href=\"#sdendnote6sym\" name=\"sdendnote6anc\"><sup>vi<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p align=\"justify\">\n<ol>\n<ol start=\"2\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">failing to prevent or stop massacres before and during the Genocide, including allowing propaganda inciting the violence;<a class=\"sdendnoteanc\" href=\"#sdendnote7sym\" name=\"sdendnote7anc\"><sup>vii<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<ol start=\"3\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">protection of those responsible including by allowing the members of the interim Genocide government to use the French embassy to form the government;<a class=\"sdendnoteanc\" href=\"#sdendnote8sym\" name=\"sdendnote8anc\"><sup>viii<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<ol start=\"4\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">exfiltration of the Habyarimana family out of the country, abandoning Tutsi and moderate Hutu politicians;<a class=\"sdendnoteanc\" href=\"#sdendnote9sym\" name=\"sdendnote9anc\"><sup>ix<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<ol start=\"5\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">establishment of Operation Turquoise, whose real aim was the protection of Hutu extremists;<a class=\"sdendnoteanc\" href=\"#sdendnote10sym\" name=\"sdendnote10anc\"><sup>x<\/sup><\/a> and <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<ol start=\"6\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">organisation of the Secure Humanitarian Zone, which allowed g\u00e9nocidaires to flee Rwanda for France and elsewhere.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">These acts of complicity are extremely serious and may well amount to breaches of Article III of the Convention for the Prevention and Repression of Genocide (\u2018Genocide Convention\u2019).<a class=\"sdendnoteanc\" href=\"#sdendnote11sym\" name=\"sdendnote11anc\"><sup>xi<\/sup><\/a> Article III prohibits not only genocide, but also: (i) conspiracy to commit genocide; (ii) direct and public incitement to commit genocide; (iii) attempt to commit genocide; and (iv) complicity in genocide. As the International Court of Justice (\u2018ICJ\u2019) has found, the obligation not to commit acts in violation of Article III applies to both individuals and States.<a class=\"sdendnoteanc\" href=\"#sdendnote12sym\" name=\"sdendnote12anc\"><sup>xii<\/sup><\/a> Any failings by French agents in respect of Article III therefore would engage the responsibility of the French State.<a class=\"sdendnoteanc\" href=\"#sdendnote13sym\" name=\"sdendnote13anc\"><sup>xiii<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">While we acknowledge the inherent difficulties in demonstrating French officials\u2019 complicity in acts contrary to Article III, in our view France is under an obligation to establish the truth as to French involvement in the Genocide and to investigate whether breaches of Article III have in fact been committed by agents of the French State. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">In this regard, we note that rights to truth and justice have been recognised as arising under Articles 3 and 8 of the European Convention on Human Rights (\u2018ECHR\u2019);<a class=\"sdendnoteanc\" href=\"#sdendnote14sym\" name=\"sdendnote14anc\"><sup>xiv<\/sup><\/a> compliance with the right to know the truth, the right to make accessible and disclose information, the right to a full and effective investigation, the right to an enforceable remedy and the right to justice is increasingly a fundamental part of the HRC\u2019s work, and the development of the international doctrine of State Responsibility.<a class=\"sdendnoteanc\" href=\"#sdendnote15sym\" name=\"sdendnote15anc\"><sup>xv<\/sup><\/a> France is a State party to the ECHR as well as a number of other international human rights treaties and is therefore under the obligations set out above. France is also an observer State of the HRC and is therefore obliged to follow its findings. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We call on France to acknowledge its role in the Genocide and\/or investigate whether its agents committed violations of Article III, whether it failed to take necessary steps to prevent the Genocide and whether it failed to investigate and prosecute those persons criminally responsible.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol start=\"2\" type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc486242073\"><\/a><span style=\"font-family: Calibri Light,serif;\">Refusal to Prosecute under <\/span><span style=\"font-family: Calibri Light,serif;\"><i>Rule 11bis<\/i><\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"5\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Following the Genocide, the UN established the International Criminal Tribunal for Rwanda (\u2018ICTR\u2019) to \u201c<\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>prosecute persons responsible for genocide and other serious violations of international humanitarian law committed in the territory of Rwanda and neighbouring States, between 1 January 1994 and 31 December 1994<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">\u201d.<a class=\"sdendnoteanc\" href=\"#sdendnote16sym\" name=\"sdendnote16anc\"><sup>xvi<\/sup><\/a> The aim of the ICTR was to try those responsible for the Genocide and to rebuild Rwanda.<a class=\"sdendnoteanc\" href=\"#sdendnote17sym\" name=\"sdendnote17anc\"><sup>xvii<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"6\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Article 8 of the ICTR Statute provides that the ICTR and national States have concurrent jurisdiction, though the ICTR has primacy over national courts.<a class=\"sdendnoteanc\" href=\"#sdendnote18sym\" name=\"sdendnote18anc\"><sup>xviii<\/sup><\/a> A key exception to this principle is the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> procedure,<a class=\"sdendnoteanc\" href=\"#sdendnote19sym\" name=\"sdendnote19anc\"><sup>xix<\/sup><\/a> which allows for the ICTR to refer a case to the authorities of a State in whose territory the crime was committed or the accused was arrested, or which has jurisdiction and is \u2018<\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>willing and adequately prepared to accept\u2019<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> such a case.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"7\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">In November 2007, the ICTR agreed to transfer jurisdiction over the prosecutions of Wenceslas Munyeshyaka and Laurent Bucyibaruta to France under the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> procedure.<a class=\"sdendnoteanc\" href=\"#sdendnote20sym\" name=\"sdendnote20anc\"><sup>xx<\/sup><\/a> The ICTR Trial Chamber approved transfer of the cases, finding that France was \u201c<\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>willing and adequately prepared to accept\u201d <\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">the cases.<a class=\"sdendnoteanc\" href=\"#sdendnote21sym\" name=\"sdendnote21anc\"><sup>xxi<\/sup><\/a> However, France has not taken sufficient steps either to prosecute or to extradite these suspects. After years of investigation, in October 2015, a French court dismissed the case against Wenceslsas Munyeshyaka citing a lack of evidence.<a class=\"sdendnoteanc\" href=\"#sdendnote22sym\" name=\"sdendnote22anc\"><sup>xxii<\/sup><\/a> Despite the recent announcement of the closing of the investigation, we still await the Prosecutor\u2019s indictment in the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Bucyibaruta<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> case. French authorities have presented a number of arguments to justify France\u2019s failures in this regard, including a lack of cooperation from ICTR regarding transfer of evidence and differences in the legal frameworks of French and ICTR law. These arguments are not accepted and point to a distinct lack of will to try the suspected g\u00e9nocidaires. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"8\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">In dismissing the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Munyeshyaka<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> case, the French investigating judges claimed that there was insufficient evidence to prove his participation in the crimes of the Genocide.<a class=\"sdendnoteanc\" href=\"#sdendnote23sym\" name=\"sdendnote23anc\"><sup>xxiii<\/sup><\/a> However, prior to transferring jurisdiction over the case to France, ICTR Judge Egorov had confirmed an indictment alleging that, among other crimes, Munyeshyaka had personally murdered three Tutsi children, raped multiple Tutsi women and girls, and aided and abetted the killing of Tutsi who had taken refuge in the Ste. Famille parish, over which he exercised effective control.<a class=\"sdendnoteanc\" href=\"#sdendnote24sym\" name=\"sdendnote24anc\"><sup>xxiv<\/sup><\/a> The investigating judges complained of obstacles to their investigation presented by a breakdown in diplomatic relations with Rwanda, procedural issues, and a lack of resources,<a class=\"sdendnoteanc\" href=\"#sdendnote25sym\" name=\"sdendnote25anc\"><sup>xxv<\/sup><\/a> notwithstanding that Rwanda continued to respond constructively to French requests.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"9\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">France\u2019s decision to dismiss the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Munyeshyaka<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> case in 2015 is in direct conflict with France\u2019s international human rights obligations, as is the delay to try Laurent Bucyibaruta. In particular, under <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">, France is not afforded the discretion to reopen investigations and\/or determine that there is insufficient evidence to prosecute in accordance with national law \u2013 this is a matter that could and should have been raised during the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis <\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">procedure prior to transfer. Under <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">, a State is expected to prosecute on the basis of the evidence provided by the ICTR, and, if subsequently unable to prosecute in accordance with national law, to request the transfer of the case back to the ICTR. Neither of these events happened in respect of France\u2019s <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> transfer cases. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"10\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">France has therefore breached the explicit undertakings it made to the ICTR and, by implication, to the UN Security Council, and has consequently failed to act in accordance with its international human rights obligations as set out under the ICTR Statute. In doing so, it has also failed to afford the victims of the Genocide truth and justice, which are fundamental principles guaranteed by the ECHR,<a class=\"sdendnoteanc\" href=\"#sdendnote26sym\" name=\"sdendnote26anc\"><sup>xxvi<\/sup><\/a> and has provided safe haven to suspected g\u00e9nocidaires. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"11\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We call on France to take all necessary steps to prosecute Wenceslas Munyeshyaka and Laurent Bucyibaruta as agreed under the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> procedure or, in the event that it is no longer \u201c<\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>willing and adequately prepared to accept\u201d <\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">the cases, to inform the UN Mechanism for International Criminal Tribunals and to facilitate the extradition of the suspects to Rwanda for prosecution.<a class=\"sdendnoteanc\" href=\"#sdendnote27sym\" name=\"sdendnote27anc\"><sup>xxvii<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol start=\"3\" type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc486242074\"><\/a><span style=\"font-family: Calibri Light,serif;\">Refusal to Prosecute Suspected G\u00e9nocidaires Residing in France <\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"12\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">In the immediate aftermath of the Genocide, many individuals suspected of complicity in the Genocide fled to France. France\u2019s failure to ensure that suspected g\u00e9nocidaires are brought to justice presents real concerns for those who fight for accountability.<a class=\"sdendnoteanc\" href=\"#sdendnote28sym\" name=\"sdendnote28anc\"><sup>xxviii<\/sup><\/a> In particular, these failings by France constitute a fundamental breach of its international legal obligations to prosecute (in the absence of extradition) suspected g\u00e9nocidaires. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"13\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">At the time of CPCR\u2019s establishment, a significant number of suspected g\u00e9nocidaires were living in France. Over the past 16 years, we have filed approximately 25 civil complaints to the Paris court for crimes against humanity. We have also repeatedly written to the highest French officials setting out our concerns regarding impunity for the Genocide throughout the administrations of Mitterrand, Chirac, Sarkozy, Hollande, and most recently Macron. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"14\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Despite these efforts, to date we have received no engagement from the French State. Very recently, during the presidential elections, we questioned all the candidates on the role of the French state in the Genocide; our letters went unanswered. Moreover, in 23 years, only three g\u00e9nocidaires have been convicted in France, not at the initiative of the Public Prosecutor, but following our civil complaints. We are therefore deeply concerned that France has failed to demonstrate a serious commitment to prosecuting suspected g\u00e9nocidaires residing in France and bring to an end the culture of impunity.<a class=\"sdendnoteanc\" href=\"#sdendnote29sym\" name=\"sdendnote29anc\"><sup>xxix<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"15\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Accountability for international crimes is of fundamental importance to the international community. As one leading commentary to the Genocide Convention sets out, France is under an obligation to prosecute acts of genocide in circumstances where it chooses not to extradite those suspects to a State with primary jurisdiction \u2013 in this case Rwanda.<a class=\"sdendnoteanc\" href=\"#sdendnote30sym\" name=\"sdendnote30anc\"><sup>xxx<\/sup><\/a> Although the ICJ held that Article VI does not entail an obligation to prosecute on States outside of whose territory genocide was committed,<a class=\"sdendnoteanc\" href=\"#sdendnote31sym\" name=\"sdendnote31anc\"><sup>xxxi<\/sup><\/a> the combination of Articles I, IV and VI means that States <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>are<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> under a duty to prosecute acts of genocide, notably when they are unwilling to extradite.<a class=\"sdendnoteanc\" href=\"#sdendnote32sym\" name=\"sdendnote32anc\"><sup>xxxii<\/sup><\/a> Indeed, this principle is consistent with the customary international law principle that States are obliged to extradite or prosecute for serious international crimes,<a class=\"sdendnoteanc\" href=\"#sdendnote33sym\" name=\"sdendnote33anc\"><sup>xxxiii<\/sup><\/a> and France\u2019s obligations under the ECHR to ensure truth and justice for victims.<a class=\"sdendnoteanc\" href=\"#sdendnote34sym\" name=\"sdendnote34anc\"><sup>xxxiv<\/sup><\/a><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"16\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We call on France to prosecute suspected g\u00e9nocidaires residing in its territory. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol start=\"4\" type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc486242075\"><\/a><span style=\"font-family: Calibri Light,serif;\">Unjustified Rejections of Extradition Requests<\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"17\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Despite repeated requests, the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Cour de Cassation <\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">has systematically refused to extradite any suspected g\u00e9nocidaires to Rwanda to face trial. To date, we understand that approximately thirty individual extradition requests have been made to France by Rwanda\u2019s National Public Prosecution Authority. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"18\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">The primary legal reason for rejecting Rwanda\u2019s extradition requests appears to be the principle of <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>nulla crimen, nulla poena sine lege. <\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">However, rejecting extradition requests on the basis of this principle is inconsistent with France\u2019s own internal laws, including its Penal Code and a law adapted following a UN Security Council resolution on the Genocide.<a class=\"sdendnoteanc\" href=\"#sdendnote35sym\" name=\"sdendnote35anc\"><sup>xxxv<\/sup><\/a> It is also inconsistent with France\u2019s international human rights obligations: by denying extradition requests, France is failing to respect its obligations under Articles 3 and 8 ECHR and victim rights to truth and justice,<a class=\"sdendnoteanc\" href=\"#sdendnote36sym\" name=\"sdendnote36anc\"><sup>xxxvi<\/sup><\/a> failing to respect its commitment to extradite or prosecute under the Genocide Convention and customary international law,<a class=\"sdendnoteanc\" href=\"#sdendnote37sym\" name=\"sdendnote37anc\"><sup>xxxvii<\/sup><\/a> and failing to observe the European Court of Human Rights\u2019 case law on Article 7 (2) ECHR and Article 15 (2) International Covenant on Civil and Political Rights.<a class=\"sdendnoteanc\" href=\"#sdendnote38sym\" name=\"sdendnote38anc\"><sup>xxxviii<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"19\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">France\u2019s latest refusal to extradite was in 2017 and fell within the last UPR cycle. We call upon France to respect its international human rights law obligations and to commence the extradition of suspected Rwandan g\u00e9nocidaires so that they can face trial. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol start=\"5\" type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc486242076\"><\/a><span style=\"font-family: Calibri Light,serif;\">Failure to Respond to a Mutual Legal Assistance Request<\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"20\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We note that in November 2016, the Government of Rwanda submitted a mutual legal assistance (\u2018MLA\u2019) request to the Government of France requesting information as to 20 French nationals suspected of involvement in the Genocide \u2013 all members of the French military \u2013 and hence State agents. Apart from a courtesy acknowledgement, we understand that the Government of Rwanda has not received a response.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"21\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">France is under an obligation to cooperate with other States in ensuring the punishment of suspected g\u00e9nocidaires.<a class=\"sdendnoteanc\" href=\"#sdendnote39sym\" name=\"sdendnote39anc\"><sup>xxxix<\/sup><\/a> Moreover, the ECHR obliges France to ensure truth and justice for victims of international crimes.<a class=\"sdendnoteanc\" href=\"#sdendnote40sym\" name=\"sdendnote40anc\"><sup>xl<\/sup><\/a> Therefore, it is our view that France remains under an obligation to assist the Government of Rwanda and respond to its MLA request to ensure the effective prosecution suspected g\u00e9nocidaires. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"22\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We call on France to cooperate with the Government of Rwanda in respect of the Rwandan MLA request. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<ol start=\"6\" type=\"A\">\n<li>\n<h3 class=\"western\"><a name=\"_Toc483172436\"><\/a><a name=\"_Toc486242077\"><\/a> <span style=\"font-family: Calibri Light,serif;\">Failures in relation to the Declassification of Documents Relating to the Genocide<\/span><\/h3>\n<\/li>\n<\/ol>\n<ol start=\"23\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">In April 2015, following calls from civil society, the French Presidency announced the declassification of documents relating to the Genocide from the National Archives. However, this disclosure was intentionally incomplete, disclosing some documents that were already in the public domain and omitting the most sensitive documents.<a class=\"sdendnoteanc\" href=\"#sdendnote41sym\" name=\"sdendnote41anc\"><sup>xli<\/sup><\/a> This incomplete \u201cdeclassification\u201d, inaccessible to the public, makes documents available for review only if permission is granted by a gatekeeper appointed by President Mitterrand.<a class=\"sdendnoteanc\" href=\"#sdendnote42sym\" name=\"sdendnote42anc\"><sup>xlii<\/sup><\/a> <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"24\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">France is obliged to cooperate with the international community in ensuring the prosecution of suspected g\u00e9nocidaires.<a class=\"sdendnoteanc\" href=\"#sdendnote43sym\" name=\"sdendnote43anc\"><sup>xliii<\/sup><\/a> France is under an obligation to ensure truth and justice for victims.<a class=\"sdendnoteanc\" href=\"#sdendnote44sym\" name=\"sdendnote44anc\"><sup>xliv<\/sup><\/a> It is our view, therefore, that France remains under an obligation to declassify and make available to all, the relevant documents. Doing so will contribute to the prosecution and punishment of suspected g\u00e9nocidaires and ensure truth and justice for victims. <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"3\" type=\"I\">\n<li>\n<h2 class=\"western\"><a name=\"_Toc486242078\"><\/a><span style=\"font-family: Calibri Light,serif;\"><b>RECOMMENDATIONS <\/b><\/span><\/h2>\n<\/li>\n<\/ol>\n<ol start=\"25\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">We are pleased to have this opportunity to constructively engage with France during its third UPR and make the following recommendations: <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Acknowledge the role of French officials in the Genocide and take steps as appropriate (and in accordance with national and international law); <\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"2\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Take further steps to prosecute Wenceslas Munyeshyaka and Laurent Bucyibaruta as contemplated under the <\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"><i>Rule 11bis<\/i><\/span><\/span><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\"> procedure or, alternatively, immediately engage with the UN Mechanism for International Criminal Tribunals to facilitate revocation of the transfer orders and the return of the cases;<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"3\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Prosecute all suspected g\u00e9nocidaires living in France;<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"4\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Authorise the extradition of suspected Rwandan g\u00e9nocidaires so that they can face trial in Rwanda;<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"justify\">\n<ol start=\"5\" type=\"a\">\n<li>\n<p align=\"justify\"><span style=\"font-family: Calibri Light,serif;\"><span style=\"font-size: medium;\">Cooperate fully with the Government of Rwanda in respect of its mutual legal assistance requests;
